Learning outcomes

Be able to critically assess the benefits and disadvantages of international trade;
2.
Be familiar with the institutional structure of international trade and how it is embedded in the general international legal order;
3.
Be able to explain how the various bi‐  or multilateral regional and other preferential trade agreements relate to the WTO;
4.
Be able to explain how the international trade legal order relates to the domestic legal order;
5.
Be able to critically engage with the core principles of international trade, non‐discrimination (national treatment), the MFN (most‐favoured nation) principle;
6.
Be able to critically engage with the dispute settlement mechanism of the WTO;
7.
Be able to critically engage with contemporary issues around international trade such as, for example, current FTA negotiation and treaty projects, controversial issues such as ISDS or the so‐called “trade and …” issues (all as presented in class).

Unit content:

International trade is one central pillar of what is commonly referred to as globalization. Technical developments and liberalization in the area of international trade have had a tremendous impact on the volume of international trade in goods and services. In this unit, we will take a closer look at the main institutions and concepts of international trade. We will critically discuss the reasoning behind trade liberalization and how it is structurally embedded in international law. We will look at the various international organizations dealing with international trade with a special focus on the WTO and the main principles of the WTO legal system. We will also engage with Free Trade Agreements and their benefits and disadvantages in the light of the universal WTO regime.
